Terms of Service

Effective from: 01 July 2026

§1. General provisions

  1. These terms set out the rules for the provision of digitization and restoration services for recordings on VHS, VHS-C and S-VHS tapes by AMG Media, ul. Przyrodnicza 2, 05-126 Michałów-Grabina, Poland, VAT ID (NIP): PL8542123967 (the "Service Provider").

  3. Placing an order constitutes acceptance of these terms.

§2. Definitions

  1. Client — a natural person, legal person or organisational unit ordering the Service.
  2. Consumer — a Client who is a natural person concluding a contract not directly related to their business or professional activity.
  3. Media — a VHS, VHS-C or S-VHS cassette entrusted by the Client.
  4. Service — digitization, picture and sound restoration, preparation of archival masters, cleaning or repair of Media, within the scope specified in the quote.
  5. Material — the content of the recording fixed on the Media and the files produced as a result of the Service.

§3. Scope of services

  1. The Service Provider provides the services described on the website, in particular: 1:1 transfer, full picture and sound restoration, preparation of archival masters (lossless formats), cleaning and repair of Media, and HD upscaling.
  2. The exact scope of work for a given order is defined each time by the individual quote.

§4. Quote and conclusion of the contract

  1. The Client submits an enquiry via the website form or e-mail, describing the number, type, approximate length and condition of the Media.
  2. The Service Provider presents an individual quote, as a rule within 24 business hours. The quote is valid for 30 days and includes the scope of work, the price and the delivery date.
  3. The contract is concluded once the Client accepts the quote (by e-mail or in another documented form).
  4. Work beyond the accepted scope (e.g. cleaning or repair of Media whose condition was revealed during inspection) is carried out only after a separate quote and the Client's approval.

§5. Delivery and return of media

  1. Media may be delivered in person (by prior appointment) or by courier or parcel locker to the Service Provider's address.
  2. The Client should pack the Media so that they are protected in transit (bubble wrap, rigid box). The Service Provider is not liable for damage arising in transit to the studio.
  3. After completion, the Service Provider returns the Media together with the files in the manner agreed with the Client. Return shipping costs are set out in the quote.

§6. Performance of the service

  1. The delivery date is set out in the quote. Digitization happens in real time, and restoration plus quality control require additional time.
  2. Every item of Media is inspected before playback. Media with mould or mechanical damage is not played without prior cleaning or repair (§4(4)).
  3. The Service Provider keeps a backup copy of the files for 30 days after the Client confirms receipt, and then permanently deletes it, unless extended archiving has been agreed.

§7. Media condition and liability

  1. Magnetic tape degrades naturally. The Client acknowledges that file quality is limited by the condition and recording quality of the Media, and that playing back Media in poor technical condition — despite the utmost care — may reveal or deepen existing damage.
  2. The Service Provider is not liable for defects in the Material arising from the condition of the Media, the quality of the original recording or pre-existing damage.
  3. The Service Provider's liability towards Clients who are not Consumers is limited to the amount of the fee for the Service. Nothing in these terms excludes or limits Consumer rights arising from applicable law.

§8. Copyright and content

  1. The Client declares that they hold the rights to the Material, or the permissions required to order the Service (private, family, own or company recordings).
  2. The Service Provider does not copy commercial releases or other material covered by third-party copyright, and may refuse orders concerning unlawful content.
  3. The Service Provider treats the Material as confidential: it is not shared with third parties and is used only to the extent necessary to perform the Service.

§9. Payment

  1. The fee is set out in the accepted quote. Payment is made by transfer to the account indicated by the Service Provider or in cash on personal collection.
  2. Files are released and Media returned once payment has been received, unless agreed otherwise.

§10. Withdrawal from the contract (Consumers)

  1. A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving a reason, by submitting a statement (e.g. by e-mail).
  2. If, at the Consumer's express request, performance of the Service began before the withdrawal period expired, a withdrawing Consumer must pay for the services performed up to the moment of withdrawal.
  3. The right of withdrawal does not apply once the Service has been fully performed, if performance began with the Consumer's express prior consent and they were informed before performance that they would lose the right of withdrawal (Article 38(1)(1) of the Polish Consumer Rights Act).

§11. Complaints

  1. Complaints may be submitted by e-mail to office@amgmedia.pl, describing the issue and providing contact details.
  2. The Service Provider handles a complaint within 14 days of receiving it and informs the Client of the outcome.
  3. A Consumer may use out-of-court complaint and redress procedures, including the ODR platform: ec.europa.eu/consumers/odr.

§12. Personal data

The processing of personal data and the confidentiality of entrusted recordings are described in the Privacy policy.

§13. Final provisions

  1. In matters not regulated here, Polish law applies, in particular the Civil Code and the Consumer Rights Act.
  2. The Service Provider may amend these terms for valid reasons; orders accepted before an amendment are governed by the previous wording.
